Woodruff, Esq."},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.soulpittmedia.com\/images\/jenycewoodruffblog.jpg\" alt=\"http:\/\/www.soulpittmedia.com\/images\/jenycewoodruffblog.jpg\" width=\"467\" height=\"282\" \/><\/p>\n<p>A Physician Employment Contract is an agreement (usually written) that is entered into between an employer and employee outlining the specific terms of employment.\u00a0 The practice of medicine is highly regulated, thus there are many differences between a physician contract and that of other professions.\u00a0 It is important to remember that when you sign a contract you are essentially stating that you agree with and understand everything that is in the contract and that you are binding yourself to the terms stated in the agreement \u2013 an act that has a significant impact on a physician both financially and professionally. <!--more--><\/p>\n<p>1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Standard Contracts<\/p>\n<p>Many employers will tell you that the contract that they are offering you, and the rest of your employment class, are standard and thus, non-negotiable.\u00a0 First, everything is negotiable.\u00a0 Second, standard contracts can be downright dangerous.<\/p>\n<ul>\n<li>Standard Contracts may not take into account your agreed upon services throughout the entirety of the contract.<\/li>\n<li>Standard Contracts may be silent on issues important to you.<\/li>\n<li>Standard Contracts may contain unenforceable provisions.<\/li>\n<li>Standard Contracts may contain troublesome clauses that should be renegotiated or at the least, fully understood.<\/li>\n<\/ul>\n<ul>\n<ul>\n<li>Indemnification Clause<\/li>\n<li>Entire Agreement<\/li>\n<li>Choice of Venue<\/li>\n<li>Intellectual Property<\/li>\n<\/ul>\n<\/ul>\n<p>2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Qualifications for the Position and Requirements for Advancement<\/p>\n<p>The employment contract handed to you may require you to be board certified and state licensed on day one of your employment, however your practical timelines may be a bit different. It is important to let your potential employer know and modify the agreement accordingly.\u00a0 What about gaining the required hospital privileges?\u00a0 Will your potential employer help you to obtain those?\u00a0 Never sign the employment contract with the intention of working something out later \u2013 your signature binds you to the terms in the contract.\u00a0 If partnership is the goal, specifying what it takes to get to partnership is a smart decision.\u00a0 Termination without cause can easily derail years of work towards a professional achievement (many times accompanied by a financial windfall).\u00a0 It is recommended that the \u201cpartnership track\u201d be completely defined and protected by, among other things, restricting certain employer actions if the physician meets clearly defined criteria.<\/p>\n<p>3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Know your Hidden Costs<\/p>\n<p>Your base salary and possible bonuses are clearly written on your contract, but what are you really being paid?\u00a0 It\u2019s imperative to take into account the various costs that you may be responsible for.<\/p>\n<ul>\n<li>Professional Liability Insurance<\/li>\n<li>Health Insurance<\/li>\n<li>Disability Insurance<\/li>\n<li>Continuing Medical Education Courses<\/li>\n<li>Medical Association and Licensing Dues and Fees<\/li>\n<li>Office Furnishings, Supplies and Equipment<\/li>\n<li>Medical Equipment<\/li>\n<li>Staff and Personnel<\/li>\n<li>Business Expenses<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Working Conditions<\/p>\n<p>It\u2019s not taboo to know how much you\u2019ll be required to work.\u00a0 It is impossible to fairly evaluate an offer without all pertinent facts.<\/p>\n<ul>\n<li>It is important to know and agree to the medical services that you will be providing.\u00a0 It is not a stretch for a urogynecologist to practice general gynecology.<\/li>\n<\/ul>\n<ul>\n<li>Where will you be working?\u00a0 A private practice may require a doctor to travel between numerous locations, work at offsite clinics, etc.\u00a0 It is important to have a clear picture of what working for a particular employer entails.<\/li>\n<\/ul>\n<ul>\n<li>What will your hours be?\u00a0 Call schedule?\u00a0 Clinic hours?
